What Is a Magistrate Hearing?

In certain cases, an individual is afforded a magistrate hearing. A magistrate hearing is one of the first steps in the criminal justice process. After a criminal complaint has been filed, an informal hearing will be held to determine whether the complaint should be issued. Also called a show-cause hearing, a magistrate hearing typically takes place in an office rather than a courtroom before formal charges are even brought. 

Don't make the mistake of thinking that because a show-cause hearing is informal that it's also not serious. It's crucial that you have a qualified legal advocate in your corner to advocate for you during this informal hearing because this hearing is where a magistrate will determine if there is enough evidence to issue a criminal complaint.

The prosecution will need to show that there is probable cause to bring the complaint, which is a relatively low evidentiary bar. If the judge finds that there is sufficient evidence, they will allow charges to go forward and a formal arraignment date will be set. However, if probable cause is not found and the judge dismisses the complaint, no charges will be filed against you.
